It is the responsibility of the seller to deliver the property vacant and in
broom swept condition. Robert was apprised of this on THREE separate
occasions and most importantly in writing on the Offer to Purchase and P&S.
The work done to close a property is quite extensive (especially when one is
on both the buy and sell side) so I'm sorry you don't appreciate the work
involved but it is extremely time consuming. I delivered all documents to
the attorney for close as it is not necessary for a broker to be at the
signing of the documents...my client wasn't there so I certainly need not be
in attendance. It was Robert's decision not to perform as required then
your decision to credit the buyer $800 so I bear no responsibility in those
actions and decisions.
