Prohibiting individuals from install open source and free software on their own hardware, including retail wifi routers and access points, is completely unacceptable. The solution is *not* to limit vendors from permitting new firmware to be burned into their hardware, including individuals installing custom firmware. Rather, the solution is to limit the power of the radio signals, if necessary -- nothing more. Stopping individuals from installing or customizing or programming their own software will only open the floodgates to custom "routers" which are even more powerful and even more intrusive. Preventing people from playing around only with over-the-counter hardware is definitely not the answer.
